Privacy Policy

 

Concerning portraits or other individual likeness

Where services involve the Artist creating a likeness of an individual, a model release form will accompany the job contract to further outline privacy and protection of rights for the Client and individual whose likeness is captured by the Artist. The Artist will not share the image (even on her social media accounts) of an Artwork involving a human likeness without permission from that individual or an appropriate representative (in the cases of young children or deceased parties).

Return of property

Upon the expiry or termination of the Agreement between Client and Artist, the Artist agrees to not share, and make all efforts to return to the Client any property, documentation, records, photos or other information which is the property of the Client and not circulate these to other parties except with Client approval.

Advertisement delay

In the case of the Artists’ Services being utilised for the purpose of a gift, the Artist agrees to delay any forms of social media or other public communication or advertising of the artwork as directed by the Client.

Copyright and Use Limitations

The rights granted by a Client or buyer of the Artists’ work in the form of prints or other media are of a Limited Use Licence and are subject to the following limitations. Client is hereby known as the “Licensee” and the Artist is hereby known as the “Licensor”. Intellectual Property is hereby known as “IP”.

  • Ownership. Title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with the Artist.

    • Licensee may not copy or distribute any of the Service IP except as necessary in connection with the performance of the Contract or as outlined in the Provisions.

    • Licensee will not modify, decompile, disassemble, reverse engineer, or create derivative works based on the Service IP in Compliance with applicable law, including but not limited to all applicable provisions of copyright and other intellectual property law. Any desire for the Licensee to do the above must receive written consent from the Licensor.

  • Provisions: The Artist grants permission for the Client to gift the material product created by these Services (the artwork) in a private manner and/or circulate its imagery for other non-commercial means such as via social media, personal photos, etc.
