Terms & Conditions

Helen Grey is a registered Australian sole trading artist. Jobs are started after discussion with clients, and a contract is signed with retainer paid. Please note that Helen is under no obligation to start a job without a signed contract and paid retainer which is non-refundable in most instances. This is to ensure the artist’s time and material costs are covered in such a case as a client to potentially change their mind. Specific terms and conditions relating to privacy, copyright, shipping and returns can be read in their own tabs on this site. For more specific concerns or details feel free to contact Helen Grey via this website, or request a template contract.

Fair trading

Please note that Helen Grey Art and Science follows the Fair Trading Act of Australia.

Postage and Handling.

Helen Grey Art and Science use Australia Post as the default postage carrier. Other postage carriers may be used at the seller’s discretion or upon buyer’s request. On the occasion of orders lost or damaged in transit, the buyer must contact the seller (Helen Grey Art and Science) to notify of the problem so that the seller can start the process of insurance claim with the postal provider. For items that are lost or damaged after delivery and not during transit this is unfortunately out of both the seller and postage carrier’s hands. For instance, a parcel is proven as delivered by the postal carrier and stolen from the buyer’s premise. In that situation it becomes a theft and a police matter. Please note that it is on the buyer to ensure correct postage details are provided on all orders. If an incorrect address is provided by the buyer and results in the parcel being delivered to the wrong address, it is recommended for the buyer to contact their postal carrier and determine if contact can be made to the recipient of the parcel. Depending on your location, police may need to be contacted to advise further. If an incorrect address is provided by the buyer and results in the parcel being returned to sender, the sender (Helen Grey Art and Science) will make attempts to contact the buyer to re confirm address to have it sent out once more. This additional postage cost will be worn by the buyer. If for any reason the sender can not make contact with the buyer to have a new postage paid for, or buyer refuses to have item returned at their expense, the item becomes the property of the sender after 30 days. Contact attempts will be made with all and any contact details provided by the buyer which may be email, phone and/or social media contact if known and applicable.

The contract:

For commission work, a contract and invoice will be sent out by the Artist (Helen Grey) once both the Artist and the client have agreed on what will be done and for what price. Work begins when the contract is signed, and a 20% non-refundable retainer has been paid. In the case of human models, a model release form MAY be signed by the client, however this is not required for work to start and is only required if the Artist wishes to have permission to show progress and/or the final artwork on her social media accounts and/or website. The client is within their rights to prefer this not to happen. The primary purpose of the contract is to protect both the client and Artist’s rights during the transaction and to ensure both parties are in agreement to the work taking place. E.g.; client agrees work will not commence and/or continue if payment is not maintained; artist agrees that ownership of any original photos of the client stays with them and will not be circulated without permission. Artist also agrees to complete the work as agreed under the conditions outlined.
